Terms of Service

1. Introduction

Terms of Service (“Terms”) govern your use of the Bookish Boutique multi-vendor marketplace (“Service”) controlled by Bookish Boutique, Inc. (collectively, “Owner,” “we,” “us,” or “our”). By using or otherwise accessing this Service, you acknowledge that you are at least thirteen years of age (or the age of majority in your jurisdiction, whichever is higher), have read these Terms, and that you agree to be bound by them. If you do not agree to the Terms, please do not use the Service.

2. Grant of License

Owner grants you a worldwide, non-exclusive, royalty-free, revocable license to access and use the Service solely for viewing, purchasing, or interacting with content within it. This license is personal to you and may not be transferred or sub-licensed to any third party. Owner does not grant you any other rights whatsoever in relation to the Service or its contents. All rights not expressly granted to you are reserved by Owner.

3. Term

These Terms will remain in effect for as long as you lawfully continue to use the Service. This license will terminate automatically without notice if you fail to comply with any term or condition herein. Upon termination, you must immediately cease using the Service. The Limitations of Warranties and Liability set out in Sections 7 and 8 will remain in force even after any termination.

4. Intellectual Property

The Service and all content within it are protected by applicable United States and international copyright, trademark, and other intellectual property laws. Unless otherwise indicated, all rights (including copyright) in the Service and its content (including but not limited to code, scripts, design elements, and interactive features) are owned or controlled by Owner. All trademarks, service marks, and trade names (registered or otherwise) are the property of Owner or its licensors.

5. Your Conduct

You agree to comply with all applicable local, state, and national laws and regulations in connection with your use of the Service. In addition, you must not:

• Use the Service to harm, threaten, or harass anyone (including Owner and its employees, officers, and directors).
• Use the Service for any purpose other than as expressly permitted by these Terms, or in a manner that violates our policies or guidelines.
• Violate the terms of our Privacy Policy (see Section 11), or any other policies referenced in these Terms.
• Share passwords or other access credentials, or otherwise authorize any third party to access or use the Service on your behalf.
• Translate, reverse engineer, decompile, or disassemble the Service or any portion of its content, or merge any part of it with another service or program.
• Remove or alter any copyright, trademark, or other proprietary rights notices contained in any Owner content.
• Copy, reproduce, or create derivative works based on any part of the Service or its content, or create a competing version of the Service based on non-public information gained from using the Service.
• Use the Service or its content for any unauthorized purpose or in violation of any applicable laws or regulations.

Owner may take any actions deemed necessary (including legal action) to address or punish violations of these Terms or any illegal or inappropriate conduct, without prior notice or warning.

6. Third-Party Websites and Content

The Service may link to third-party websites. We do not monitor or control these external sites and are not responsible for their content or accuracy. Accessing third-party sites is done at your own risk. Our Privacy Policy (Section 11) discloses the third-party partners we work with to provide the Service.

7. Limitation of Warranties and Liability

The Service and all associated content are provided on an “as is” basis, without warranties of any kind, express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose. You assume all responsibility and risk for using the Service. Owner disclaims all liability for any loss, injury, or damage resulting from use of the Service or any linked third-party site. In no event will Owner be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of revenue or profit, lost or damaged data, or other commercial or economic loss. Owner’s total aggregate liability with respect to these Terms or the Service will not exceed $1.00 USD or equivalent. These limitations apply regardless of whether the alleged breach is a fundamental condition or term.

8. Indemnity

You agree to indemnify and hold harmless Owner, its subsidiaries, affiliates, officers, agents, employees, advertisers, licensors, and partners from any third-party claim arising out of your use of the Service, violation of these Terms, or any other actions in connection with the Service’s content. This includes liability for all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorneys’ fees, of any kind.

9. General

These Terms constitute the entire agreement between you and Owner regarding the subject matter herein and supersede any prior agreements. Owner may amend or modify these Terms at any time, without notification to you. Owner may also update or change the Service at any time without notice. You may need to update third-party software or services periodically in order to continue using the Service effectively.

10. Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Bookish Boutique, Inc. is registered or where it maintains its principal office, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of such courts.

11. Privacy

We take your privacy very seriously. The Privacy Policy in respect of the use of this Service can be found at /privacy. By using the Service, you agree to be bound by our Privacy Policy, which is incorporated by reference into these Terms.
